Legal Actions Targeting Financial Institutions having Jeffrey Epstein Connections May Reveal Fresh Insights on Billionaire’s Crimes

For years, victims of Jeffrey Epstein have demanded accountability. At one point, it appeared like they would achieve it.

Ghislaine Maxwell, the financier’s one-time partner, was found guilty of sex trafficking four years ago for her involvement in the deceased billionaire’s sexual abuse of underage females – and sentenced to two decades behind bars.

Meanwhile, banks that had worked with Epstein, while not admitting wrongdoing, agreed to pay substantial sums in settlements to survivors. Donald Trump even made disclosing the documents related to the Epstein probe part of his election promises, and reiterated on his promise to do so early this year.

Ultimately, Trump’s justice department did not release these records, and his administration has become embroiled in reports about personal connections between him and Epstein. Assurances from lawmakers to disclose documents have stalled, due to political jockeying and delays from federal authorities.

However recent legal actions could shed light on Epstein’s operations amid the deadlock – regardless of their outcome.

Lawsuits Aim at Leading Financial Institutions

The legal complaints, filed by an unnamed accuser against Bank of America and the BNY Mellon, claim that these banking giants unlawfully facilitated Epstein’s trafficking ring. The cases are helmed by attorney Sigrid McCawley, of Boies Schiller Flexner, and lawyer Brad Edwards of Edwards Henderson, who have consistently advocated for Epstein victims.

“The financier carried out these offenses by means of not only his own extraordinary wealth and power, but through financial backing and financial support from both private parties and institutions, including the bank,” the legal filing states. “Egregiously, BNY had a plethora of information regarding Epstein’s sex trafficking operation but opted for financial gain over protecting the victims.”

The Bank of America suit echoes these allegations, declaring the institution “deliberately supplied the monetary resources and the veneer of institutional legitimacy for Epstein and his accomplices to fuel their global trafficking enterprise under the guise of legal commercial dealings”. The legal action also said the bank neglected to file mandatory financial alerts.

Legal Experts Weigh In on Case Challenges

Experienced lawyers who spoke to the matter said establishing liability would be difficult. But they also noted possible outcomes which could provide solace to plaintiffs or release of previously hidden details.

Neama Rahmani, a ex-government lawyer who founded West Coast Trial lawyers, said proof has to show that an bank’s conduct resulted in harm.

“I don’t think the lawsuit has much of a chance of success – and clearly I am on the side of the survivors, and I want them to get explanations and criminal justice and financial recovery,” the attorney said. Certain allegations might be too tangential from a juridical perspective.

“It all comes down to evidence,” he said. A lawyer would need to prove causation, which would mean “but for the defendant’s conduct, the harm wouldn’t have occurred”. In this case, that would boil down to “but for the bank’s conduct, the survivor maybe wouldn’t have been exploited”, the lawyer clarified.

A lawyer would also have to go further than a basic causation test. “Is not just ‘but for’ causation. It also has to be a substantial factor: that is the legal test. So whatever misconduct there was, if there was any misconduct … the bank’s actions has to have been a substantial factor in leading to the victim’s suffering.

“By engaging in a business relationship with Epstein, is that a substantial factor? It’s uncertain.”

Liability aside, suits like this could serve as a warning that associations with those accused of wrongdoing can have negative consequences for them.

“It’s a PR nightmare,” he said. If the financial institutions try to get these suits dismissed and fail, the attorney anticipates a swift settlement. “No party desires to pursue any of the Epstein-related cases.”

Attorney Eric Faddis, a litigator and founder of the legal practice Varner Faddis and former prosecutor, said companies can be responsible. In this scenario, “whether the banks have liability is going to hinge, in part, on their level of awareness, whether they had any knowledge of claimed misconduct or criminal wrongdoing”, and in some way provided assistance to Epstein.

“However, even in that case, I think it’s going to be difficult to effectively connect the banks into some kind of sex-trafficking scheme. The institutions would likely not be privy to the details of claims,” Faddis said. While the financier’s prior legal case was public, “it’s not illegal for a bank to have a client who’s an unsavory person”.

“However, it is unlawful for a bank to in any way be involved in the criminal activity of a customer, but those two issues are very different, and so I think that it’s going to be a difficult case against the institutions.”

Possible Advantages for Victims

Nevertheless, important aspects of the legal proceedings could assist Epstein survivors.

“The lawsuits have the potential to reveal more information about the continuing Epstein story,” the attorney said. “Even though there have been sort of walls put up at every turn for folks pursuing this data, when there’s a lawsuit, there’s a discovery process, and that discovery process often mandates disclosure of information that was not formerly available.”

Attorney Brad Edwards said in a statement that the lawsuits could have a deterrent effect and achieve what legislators have failed to do.

“The lawsuits are necessary for complete justice for the survivors of Jeffrey Epstein – as well as for future would-be victims who will be harmed from similar trafficking organizations – if our banks are not made responsible for the essential role each plays, either in providing the required framework for the illegal operation or identifying the monetary aspect of these crimes and stopping it.

He added: “We have a far better chance of making a real difference than Congress, because we understand the facts and background of the case and are not motivated by partisan interests but rather by a genuine desire to create substantial impact and to protect the victims, who have already endured immense pain.

“Our handling of these issues without any political agenda and thus cannot be deterred by obstructions, protecting wealthy politically connected individuals, or the other shameful political maneuvering you and the rest of the world have had to watch unfold recently.”

Attorney Sigrid McCawley said in a statement: “While legislators attempt to uncover how the financier was able to conduct his criminal sex-trafficking enterprise for decades without being caught, we are taking a further significant action forward toward legal resolution for survivors.”

Bank Responses

When requested for a statement on the lawsuit, BNY said: “The allegations in the case are baseless, and we will vigorously defend against it.”

The bank’s response likewise stated: “We intend to firmly protect our interests in this case.”
