The Platform X Wins Legal Challenge to Allow Viewing for Australian Users to Controversial Video Content

In a significant regulatory appeal, a national review panel has overturned a prior decision that blocked Australian-based users from accessing recorded content of the shooting incident involving influencer Charlie Kirk. This challenge was lodged by Elon Musk's social media platform, arguing against an order issued at the request of the online safety regulator.

Details of the Original Classification Ruling

Following the fatal shooting of Charlie Kirk at a US campus in last year, the regulator petitioned the review board to assess and rate the circulating video. It initially ruled the content was "unable to be classified", a rating that empowered the commissioner to order social media companies to restrict access to the videos for an Australian audience.

The platform X filed an appeal for two separate videos depicting the Kirk incident. It also appealed a comparable ban on another piece of footage—depicting the attack on Iryna Zarutska on a train in Charlotte—which had also been classified as "refused classification".

The Platform's Case and Final Ruling

In its appeal, X asserted that the Kirk video contained only a short moment of violence with no visible weapon. It was argued the recording was low-quality and the focus shifted rapidly from the victim to the bystanders.

X maintained the footage was not excessively detailed, gratuitous, or objectionable, adding that it served as a neutral objective record of "a notorious public event of historical and political significance that generated extensive public discourse". The platform even compared the video and the historic film of the JFK shooting.

The majority of the review board ultimately agreed that, "notwithstanding the heinous nature of the event," the video did not reach a level that was exploitative, gratuitous, or offensive enough to warrant a 'refused classification' rating. However, they noted that a more detailed depiction with alternative commentary might have resulted in a different ruling. Consequently, the board changed the rating of the content to R18+.

A Dissenting Viewpoint

Some on the panel disagreed, contending the post was "content designed for sharing for the likely purposes of entertainment and/or benefit (such as engagement metrics)". This view stated the comparison to the Zapruder JFK film was invalid, as that footage was released years after the assassination, "once emotions regarding it had subsided".

Reactions to the Decision

Posting on its global government affairs account, the platform welcomed the decision.

"We challenged this decision to uphold freedom of expression and the importance of access to information about matters of public significance. We remain dedicated to protecting these fundamental values."

A spokesperson for the eSafety commissioner acknowledged the board's decision, but noted that the revised classification now implies platforms "have obligations to ensure R18+ material is not accessible to users who are minors".

Recent Developments on Sensitive Footage

In related news, the eSafety commissioner has not issued formal notices to social media companies this week regarding graphic footage from the Sydney beach incident circulating on social media. The regulator stated that while the images were distressing, they had not met the required standard for a "refused classification" rating.

As an alternative, the companies have been instructed to use sensitive content labels and interstitials, such as obscuring the image, on this material in line with their own content policies.
